Special Terms & Conditions

Applies to: All customers who make payments on bnshardware.lk using the Sampath Bank Internet Payment Gateway (the “Gateway”).

1. Scope & Acceptance

1.1 By selecting the Sampath Bank payment option and completing your payment you acknowledge and agree that your payment will be processed under the terms of Sampath Bank PLC and BNS Hardware (Pvt) Ltd (collectively “we/us/the Merchant”) and that you have read, understood and accepted these Special Terms & Conditions.

1.2 These Special Terms & Conditions are supplemental to our main Terms of Sale, Refund & Returns and Privacy Policy. In case of conflict, the Gateway terms required by Sampath Bank prevail for matters related to payment processing, refunds via the Gateway, chargebacks and transaction evidence.

2. Secure Processing and Data Handling

2.1 Payments are processed via a secure 128-bit SSL link to Sampath Bank’s payment server. Card PANs (full card numbers) are not stored by the Merchant; only masked card information (for example first/last four digits) and transaction references appear on receipts and confirmations.

2.2 By using the Gateway you consent to the Merchant sharing necessary transaction and business information with Sampath Bank (and, where applicable, with Alipay or other payment partners) for the purpose of processing your payment and performing due diligence.

2.3 The Merchant will collect and retain customer registration and KYC fields as required by Sampath Bank. Mandatory customer fields include: full name, residential address, contact details, email address and NIC/Passport number (or equivalent). These details are collected for fraud prevention, regulatory compliance and refund/chargeback handling.

3. Payment Acceptance, Authorization & Decline

3.1 All card and electronic payments are subject to final authorization and settlement by Sampath Bank and the card issuer/payment partner. The Bank may decline, reverse or withhold settlement for any transaction for legitimate reasons including (but not limited to) suspected fraud, disputed goods/services, card expiry, geographic restrictions, or breach of these Terms.

3.2 If a transaction is reversed or declined after settlement, the Merchant authorizes Sampath Bank to debit your order settlement (or Merchant account) to correct the reversal/chargeback as required by the Bank’s rules.

4. Refunds, Cancellations & Chargebacks

4.1 Refunds initiated by the Merchant for transactions paid through the Gateway will be processed back to the original card/account via Sampath Bank. The Merchant will instruct Sampath Bank to make the refund and will reimburse the Bank for the refunded amount where necessary.

4.2 If the Merchant decides not to proceed with an order, the Merchant will reverse/refund the transaction back to the card/account within 5 working days from the date of that decision (or as agreed between Merchant and Bank). Customers will be notified by email and/or SMS.

4.3 Chargebacks initiated by cardholders are handled in accordance with Sampath Bank and card network rules. Customers must cooperate with investigations and provide requested transaction evidence. The Merchant is required to provide transaction evidence to the Bank within 5 working days when requested. Failure to provide timely evidence may result in chargeback liability for the Merchant.

5. Delivery, Identification & Goods Collection

5.1 Goods ordered on the website will be delivered only to the address provided by the purchaser at checkout. The Merchant may require the cardholder to be present at delivery and to present the original card and/or valid photo ID (NIC/Passport). Third-party collection is not permitted unless specifically agreed and new proof of identity is provided. These measures are in place to mitigate fraud.

5.2 For vouchers/coupons collected at a showroom/outlet, the cardholder must present the card used for payment and valid ID. The Merchant may refuse to deliver if identity or card authenticity cannot be verified.

6. Registration & Transaction Communications

6.1 Customer registration is required for all purchases using the Gateway. Required registration fields (at minimum): full name, residential address, contact number, email address and NIC/Passport number. This information will be used for delivery, refund/chargeback handling and regulatory KYC/AML purposes.

6.2 Payment confirmation emails will be sent to the customer and must contain: customer name, address, contact, email, masked card digits (first/last four digits), transaction reference, amount, transaction ID, date and service description. The Merchant will maintain a track of sent confirmations and will archive email confirmations per clause 9 below.

7. Prohibited Products & Merchant Refusal

7.1 Transactions involving prohibited products (see Annexure II in Sampath Bank’s merchant terms) are strictly forbidden for processing via the Gateway. If a transaction involves a Prohibited Product, the Bank and/or Merchant may refuse or reverse the payment and pursue legal remedies. Examples (non-exhaustive) include weapons, certain pharmaceuticals, counterfeit goods, gambling devices, illicit financial services, virtual currencies, and other items listed by the Bank.

7.2 The Merchant reserves the right to refuse, cancel or hold any order where the Merchant reasonably suspects fraudulent activity or any violation of these Terms, Gateway rules or applicable laws.

8. Sub-Merchants, Marketplaces & Third Parties

8.1 If the Merchant lists sub-merchants or third-party sellers on its platform, the Merchant will notify Sampath Bank in advance of the details of each sub-merchant and ensure sub-merchants are bound by the same Gateway terms and compliance measures.

8.2 Where a particular sub-merchant’s average monthly turnover exceeds thresholds required by Sampath Bank, the Merchant will inform the Bank and support any due diligence required.

9. Record Retention & Transaction Evidence

9.1 The Merchant will retain transactional evidence, delivery acknowledgements, confirmation emails and other supporting documents and make them available on request. Where specific partners or payment schemes require longer retention (for example Alipay special terms), the Merchant will retain transaction records for up to 5 years for compliance and dispute resolution. Where the Gateway guidance dictates shorter/longer periods for particular records, the Merchant will comply.

9.2 Email confirmations and delivery acknowledgements will be archived for at least 8 months as operational evidence.

10. Fees, Commissions & Adjustments

10.1 Any fees, setup charges, commission rates and other charges relating to the Gateway are applied by Sampath Bank and may be deducted from settlement funds as authorised by the Merchant in the Merchant’s agreement with Sampath Bank. The Bank may revise its fee structure with notice; the Merchant will implement such changes as required.

10.2 In the event settlement funds are insufficient to process a refund, Sampath Bank may debit the Merchant’s account to effect the refund, as authorized under the Merchant-Bank agreement.

11. Anti-Money Laundering (AML) & Compliance

11.1 The Merchant and customers must comply with applicable AML and KYC regulations. The Merchant will report suspicious transactions to Sampath Bank and relevant authorities and will support investigations as required. Customers may be required to provide further identity documentation prior to fulfilment or refund.

12. Liability & Indemnity

12.1 The Merchant and the Bank each retain rights to indemnity. Customers agree to hold Sampath Bank and the Merchant harmless from losses arising from misuse, fraudulent transactions or customer-caused disputes to the extent permitted by law. The Merchant will be liable for losses arising from its negligence or willful misconduct.

12.2 The Bank has the absolute right to terminate or suspend Gateway services to the Merchant if it deems there is a breach of the Merchant-Bank agreement or for regulatory/compliance reasons.

13. Customer Cooperation & Dispute Resolution

13.1 Customers must cooperate with any investigation into disputed or suspicious transactions and provide requested evidence (IDs, proof of delivery, correspondence) promptly. Failure to provide evidence may affect the outcome of the dispute/chargeback in favour of the Merchant or the Bank.

13.2 Any queries relating to payments made through the Gateway should be sent to: accounts@bnshardware.lk (or other Merchant support contact). The Merchant will liaise with Sampath Bank where bank-side action or evidence is required.

14. Changes to these Special Terms & Conditions

14.1 The Merchant may update these Special Terms & Conditions to reflect changes required by Sampath Bank, card schemes, law, or operational improvements. Updated terms will be posted on the website and the effective date amended. Continued use of the Gateway after publication of changes constitutes acceptance.
